  • NY going after yoga studios-we could be next

    It seems New York State and City are going after yoga studios for taxes and licensing fees. The issues seem relevant to pole studios, although we're not currently implicated.

    The issues in question:

    -Independent contractor vs. employee status. I think we've all had this discussion many times. Just goes to show that if you classify the wrong way, it CAN come back to bite you.

    -Occupancy license. For some reason, fitness studios have to pay this, and dance studios don't. Which one is yoga? Yogis say dance. State stays fitness. I have no idea why dance studios don't have to pay this; I think this is one of those random state laws.

    -Cracking down on "teacher training." Looks like this is back from 2009, but the state had been trying to say teacher training courses needed to be licensed. The yogis won the fight and got exempted, but it's still something that could happen to pole and aerial schools.

    Just something that came across my desk that I thought pole studio owners and aspiring owners should take a look at. I'm not a yoga person and no longer live in NY, but I can see plenty of parallels with our situations.

    I imagine we will not be far behind in this.  I have SO many opinions on this subject!  I have been an independant contractor for various businesses in my life and some truly were IC positions and others resulted in the person using IC's turning into a bully and trying to leverage power and control over IC's as if they were employees.

    My current IC position is very much a legal IC position and it's been a long time since I've had that kind of relationship and it's nice.
